David Hollinbeck Killed in San Marcos Multi-Vehicle Crash on West Wonder World Drive at Purgatory Creek Bridge; Kyle Nissen Charged

San Marcos, Texas (October 2, 2020) – The driver who caused a multi-vehicle crash that left a man dead earlier last month in San Marcos has been charged, according to police.

Kyle Nissen, 30, of San Marcos, has been charged with intoxication manslaughter with a vehicle, intoxication assault with a vehicle causing serious bodily injury, and unlawful carrying of a weapon.

The fatal crash happened around 1:00 p.m., September 6, on West Wonder World Drive at the Purgatory Creek Bridge.

Police said Nissen was driving a 2011 Ford F-250 westbound in the left lane when he drifted to the right and side-swiped a Nissan Rogue. The Ford then drifted back to the left, crossed the center double-yellow stripe, and crashed head-on into a 2020 Ford F-150, a Chevrolet Silverado, a 2018 Mazda CX9, and a 2012 Nissan Altima.

The driver of the 2020 Ford F-150, David Hollinbeck, 61, of San Antonio, was killed in the crash. His wife was taken to the hospital, where she was treated and released.

The other drivers and passengers of the other vehicles were taken to Ascension Seton Hays Hospital in Kyle. Several had serious but not life-threatening injuries.

Nissen was driving at nearly 95 mph in a 55 mph zone. His BAC level at the time of the crash was more than three times the legal limit. He turned himself in to the authorities on Monday after San Marcos police issued warrants and was charged. He posted a $22,500 bond and left jail.

The authorities are investigating the crash.

We pass our sincere condolences to the family and friends of David Hollinbeck.

In Texas, a driver is legally intoxicated after consuming alcohol if their blood alcohol content (BAC) is .08% or higher. A driver is also considered intoxicated if they don’t have the normal use of their mental or physical faculties by reason of the introduction of alcohol. Alcohol however is not the only intoxicant, as drivers can become intoxicated by ingesting prescription and illegal drugs such as crack, marijuana, and cocaine.

Regardless of what substance caused the driver’s reaction time to become significantly altered, intoxication by any means can cause terrible accidents and injuries.

Innocent victims harmed by drunk drivers are entitled to compensation for their injuries, including but not limited to medical expenses; lost wages; pain and suffering and mental anguish; physical impairment and disability; and most importantly, punitive damages to deter future conduct. If a death occurred because of a drunk driver, you will want a knowledgeable accident lawyer to bring a wrongful death action against the drunk driver.
