David Lewandowski Killed, Nicholas Agustin and Kimberly Thomas Injured in Smith County Two-Vehicle Crash on State Highway 110

Smith County, Texas (October 3, 2022) – One person was killed, and two others were injured early Sunday morning in a two-vehicle crash in Smith County, according to the Texas DPS.

The fatal crash happened around 4:30 a.m., October 2, on State Highway 110, just north of Tyler.

DPS said Nicholas R. Agustin, 19, of Tyler, was driving a Ford southbound on the highway when he lost control, entered into the northbound lanes, and struck a Honda driven by Kimberly N. Thomas, 37, of Woodway.

Thomas was taken to a Tyler medical center with serious injuries. A passenger in his vehicle, David C. Lewandowski, 51, of Hewitt, was pronounced dead at the scene.

Agustin was taken to a local hospital with non-life threatening injuries. He was later arrested and booked on charges of intoxication manslaughter with a vehicle, intoxication assault, and possession of between 4 and 200 grams of a controlled substance. He was being held at the Smith County Jail on bonds totaling $1.1 million.

The crash remains under investigation.
