Marina Amaya Killed, Jairo Amaya and Telma Argueta Injured in Wharton County Train Crash on CR 214 at US-59

Wharton County, Texas (September 17, 2021) – One person was killed, and two others were injured Friday night in a train crash in Wharton County, according to the DPS.

The deadly crash happened around 8:43 p.m., September 10, on County Road 214 at US-59.

DPS said Jairo Amaya, 22, was driving a Ford Focus southeast on CR 214 when he attempted to cross over the train tracks, and the Ford was struck by a northbound train.

The train dragged the Ford about half a mile before coming to a stop.

Jairo’s mother, Marina Amaya, 43, was pronounced dead at the scene.

Jairo and another passenger, 34-year-old Telma Argueta, were taken to the hospital for treatment.

Argueta has since undergone multiple surgeries and is finally in stable condition.

Family members said there’s no railroad crossing signals at the intersection and no lights in that area.

A GoFundMe has been set up to help with funeral expenses and to help support the victims’ children.

The Texas Department of Public Safety is investigating the crash.

“When a person has suffered a grave personal injury in an accident due to someone else’s negligence, the most overwhelming emotion they feel is a sense of injustice. They often ask how such a life-altering event could have happened to them,” attorney Joel A. Gordon said. “The next question usually is, who can help me?” Mr. Gordon added.

A legal advocate can represent an injury victim or the family of a deceased victim. The attorney will file a claim on behalf of the victim and will have the responsibility of citing existing codes, laws or statutes which were violated.
