Wyatt Mask and Preslee Mask Killed in Parker County Three-Vehicle Crash on State Highway 199

Parker County, Texas (December 31, 2020) – A mother and her two young children were killed Monday afternoon in a three-vehicle crash in Parker County, just west of Springtown, according to the Texas DPS.

The fatal crash happened around 12:35 p.m., December 28, on State Highway 199, northwest of Fort Worth.

DPS said Brittany Nicole Counts, 25, of Springtown, was driving a 2007 Ford Edge when she failed to control her speed and rear-ended a 2017 GMC pickup that had slowed down to turn left onto Park View Court. The impact caused Counts to lose control and spin into the westbound side, where she was hit by a 2016 Ford F-150 pickup driven by 72-year-old Beauford Basped, Jr., of Kennedale.

Counts, her son Wyatt Mask, 7, and daughter Preslee Mask, 4, were killed in the crash.

Basped was taken to a Fort Worth hospital with non-life-threatening injuries.

The GMC driver, Michael Pesqueda, 50, of Springtown, was uninjured in the crash.

The authorities are investigating the crash.

Who May Make a Wrongful Death Claim in Texas?

A wrongful death claim for a family member may be brought by spouses, children or parents. The State of Texas also allows the estate of the deceased to bring a survival action to recover for past medical expenses and conscious pain and suffering, as well as other non-economic damages which the deceased may have suffered before death. Texas does not permit brothers, sisters, cousins, or grandparents to assert any claims for the death of a family member.

Wrongful death claims require an attorney who understands the complexity of the damages caused by a significant loss. The lawyer representing the client has the responsibility to hire the necessary experts to help prove the case.
