5-Year-Old Boy Killed in Houston Car Crash on Southwest Freeway at Fountain View Drive; Sebastian Matta Charged

Houston, Texas (April 13, 2021) – A 5-year-old boy was killed early Sunday morning in a DUI crash that left his father injured in SE Houston, according to the authorities.

The deadly crash happened on April 11, at the intersection of Fountain View Drive and Southwest Freeway service road.

Police said a Nissan Sentra was traveling southbound on Fountain View Drive when it entered the intersection on a green light and was struck by a BMW 545i sedan that was traveling northbound on the Southwest Freeway service road.

The impact caused the Nissan to roll over.

The Nissan driver and his 5-year-old son were taken to the hospital, where the child was pronounced dead. His name has not been released. The father had minor injuries.

Witnesses said the BMW driver, Sebastian Matta, 26, attempted to flee the scene on foot, but they stopped him.

Officers said Matta was intoxicated at the time of the crash and has been charged with intoxication manslaughter.

The crash remains under investigation.

In Texas, a driver is legally intoxicated after consuming alcohol if their blood alcohol content (BAC) is .08% or higher. A driver is also considered intoxicated if they don’t have the normal use of their mental or physical faculties by reason of the introduction of alcohol. Alcohol however is not the only intoxicant, as drivers can become intoxicated by ingesting prescription and illegal drugs such as crack, marijuana, and cocaine.

Regardless of what substance caused the driver’s reaction time to become significantly altered, intoxication by any means can cause terrible accidents and injuries.

Innocent victims harmed by drunk drivers are entitled to compensation for their injuries, including but not limited to medical expenses; lost wages; pain and suffering and mental anguish; physical impairment and disability; and most importantly, punitive damages to deter future conduct. If a death occurred because of a drunk driver, you will want a knowledgeable accident lawyer to bring a wrongful death action against the drunk driver.
