Rusk County, Texas (December 5, 2023) – One person was killed and another one was injured Friday afternoon in a two-vehicle crash in Rusk County, according to the DPS.

The fatal crash happened around 4:45 p.m., December 1, on US Highway 79, about four miles outside Henderson.

DPS said a Western Star truck tractor with a towed trailer was traveling southwest on the highway while James Pinkerton, 74, of Henderson was traveling behind the trailer in a 2002 Toyota Echo.

The truck driver made a U-turn with part of the trailer still in the southwest lane of US 79 and Pinkerton’s vehicle struck the trailer and traveled off the roadway before striking a culvert.

Pinkerton was pronounced dead at the scene. Pinkerton’s passenger, Charles Hebert, 79, of Alvin, was transported to UT Health Hospital in Henderson for treatment.

The troopers are investigating the crash.

Common Causes of Automobile Accidents

There are many different reasons why automobile, pedestrian, 18-wheeler, bicycle, and motorcycle accidents occur, including driver negligence, driver inattention, texting and driving, speeding, fatigue, failure to yield the right of way from a stop sign, or private drive, running a red light, and driving under the influence of alcohol or drugs. While the factors listed above are the main causes of most accidents, there may also be other factors involved, which is why it’s important that an investigation be conducted before evidence disappears, especially in cases involving a fatality.  At Joel A. Gordon & Associates, we will act quickly to secure accident scene photos, interview witnesses, obtain police records, and secure other valuable evidence needed to win your case.  Call now for a free consultation.
