5-Year-Old Boy Killed in Houston Two-Vehicle Crash on Southwest Freeway at Fountain View

Houston, Texas (April 12, 2021) – A 5-year-old boy was killed, and his father was injured early Sunday morning in a DUI crash in Houston, according to authorities.

The deadly crash occurred around 3:30 a.m., April 10, on the Southwest Freeway at Fountain View.

Police said a BMW was traveling northbound on the Southwest Freeway feeder road when it collided with a Nissan that was traveling on Fountain View.

The force of the impact caused the Nissan to roll over.

The Nissan driver and his 5-year-old boy, who was restrained in a child safety seat in the back, were taken to the hospital, where the boy was pronounced dead. The father’s condition was not disclosed.

According to witnesses, they stopped the BMW driver who wanted to flee the scene on foot.

Officers said the BMW driver appeared to be intoxicated, and charges against them are pending.

The authorities are investigating the crash.

In Texas, a driver is legally intoxicated after consuming alcohol if their blood alcohol content (BAC) is .08% or higher. A driver is also considered intoxicated if they don’t have the normal use of their mental or physical faculties by reason of the introduction of alcohol. Alcohol however is not the only intoxicant, as drivers can become intoxicated by ingesting prescription and illegal drugs such as crack, marijuana, and cocaine.

Regardless of what substance caused the driver’s reaction time to become significantly altered, intoxication by any means can cause terrible accidents and injuries.

Innocent victims harmed by drunk drivers are entitled to compensation for their injuries, including but not limited to medical expenses; lost wages; pain and suffering and mental anguish; physical impairment and disability; and most importantly, punitive damages to deter future conduct. If a death occurred because of a drunk driver, you will want a knowledgeable accident lawyer to bring a wrongful death action against the drunk driver.
