Leander, Texas (September 12, 2020) – The two people who were killed in a hit-and-run crash early Wednesday morning in Leander have been identified as John Ware, 40, and his 17-year-old son John Ware Jr. of Bertram, according to police.

The fatal crash occurred around 12:20 a.m., September 9, at the intersection of U.S. 183 and U.S. 183A tollway.

Police said Ware and his son were riding in a 2008 Suzuki motorcycle northbound on U.S. 183 when a southbound 2016 BMW driven by 21-year-old Allan Justin Gaytan ran a red light on the tollway and hit the motorcycle.

Ware and his son were pronounced dead at the scene. Ware Jr. was a student at Burnet High School.

Gaytan fled the scene after the crash. He entered the QT convenience store and then tried to escape into a nearby wooded area. He was later located and arrested.

The crash remains under investigation.

We pass our sincere condolences to the family and friends of John Ware and John Ware Jr.

Who May Make a Wrongful Death Claim in Texas?

A wrongful death claim for a family member may be brought by spouses, children, or parents. The State of Texas also allows the estate of the deceased to bring a survival action to recover for past medical expenses and conscious pain and suffering, as well as other non-economic damages which the deceased may have suffered before death. Texas does not permit brothers, sisters, cousins, or grandparents to assert any claims for the death of a family member.

Wrongful death claims require an attorney who understands the complexity of the damages caused by a significant loss. The lawyer representing the client has the responsibility to hire the necessary experts to help prove the case.
